7.            2018 Legislation:

 

a.            SB2653, SD1, HD1, CD1 Relating to Chapter 453, Hawaii Revised Statutes

 

Establishes requirements for licensure by endorsement for physicians, surgeons, and osteopathic physicians beginning December 31, 2018.  Appropriates moneys.

 

b.            HB2578, HD2, SD1 Relating to Physician Assistants

 

Establishes biennial requirements of forty credit hours in specified continuing medical education programs for renewal of physician assistant license, beginning with the renewal for the licensing biennium on February 1, 2020, and every biennial renewal thereafter. Authorizes the Hawaii Medical Board to conduct random document audits to enforce compliance. (SD1)

 

c.             SB2298, SD2, HD3, CD1 Relating to Healthcare Preceptor Tax Credits

 

Allows advanced practice registered nurses, pharmacists, and physicians to receive income tax credits for acting as preceptors in volunteer-based supervised clinical training rotations provided to eligible students that enable the students to obtain an eligible healthcare professional degree or certificate. Applies to taxable years beginning after December 31, 2018. 

 

e.            HB1906, HD2, SD2, CD1 Relating to Health Care Workers

 

Makes intentionally or knowingly causing bodily injury to certain health care workers a Class C felony. (HB1906 CD1)

 

f.              SB270, SD1, HD2, CD1 Relating to Minors

(Carried over to the 2018 Regular Session)

 

Prohibits specific state-licensed persons who are licensed to provide professional counseling from engaging in, attempting to engage in, or advertising sexual orientation change efforts on minors. Establishes the sexual orientation counseling task force to address the concerns of minors seeking counseling on sexual orientation, gender identity, gender expressions, and related behaviors. (CD1)

 

g.            SB2646, SD1, HD3, CD1 Relating to Prescription Drugs

 

Requires prescribers of certain controlled substances to consult the State's Electronic Prescription Accountability System before issuing a prescription for the controlled substance, under certain circumstances. Provides that a violation by a prescriber shall not be subject to criminal penalty provisions but that a violation may be grounds for professional discipline. Repeals on June 30, 2023. (CD1)

 

h.            HB1602, HD2, SD1, CD1 Relating to Opioids

 

Requires the inclusion of a label warning of the risks of addiction and death on the packaging of any opioid drug dispensed by a health care professional or pharmacist. (HB1602 CD1)

 

i.              HB2145, HD1, SD1, CD1 Relating to Medication Synchronization

 

Allows the synchronization of plan participants' medications. Requires plans, policies, contracts, or agreements that are offered by health insurers, mutual benefit societies, and health maintenance organizations and provide prescription drug benefits, to apply prorated daily cost-sharing rates for prescriptions dispensed by network pharmacies for less than a thirty-day supply. (HB2145 CD1)

 

j.              HB2729, HD2, SD2, CD1 Relating to Cannabis for Medical Use

 

Establishes standards and criteria for reciprocity for qualifying out-of-state medical cannabis patients and caregivers including limitations, and safeguards. Authorizes extension of written certifications of a debilitating condition for up to three years for chronic conditions. Clarifies a dispensary licensee's right to retest marijuana or manufactured cannabis products for compliance with standards. Authorizes establishment of a bona fide provider-patient relationship via telehealth. Authorizes dispensing of devices that provide safe pulmonary administration of medical cannabis by dispensary licensees. Increases the allowable tetrahydrocannabinol limit for of certain manufactured cannabis products. Limits felony convictions that disqualify an individual from employment with a dispensary licensee. Establishes a working group to make recommendations regarding employment of qualifying patients and manufacture and dispensing of edible cannabis products. (HB2729 CD1)
