    NOTICE OF MEETING 

    Pursuant to Hawaii Revised Statutes (“HRS”) chapter 92, the Campaign Spending Commission (“Commission”) plans to hold this meeting remotely by interactive conference technology with Commission members, Staff, and Respondents participating simultaneously.  Individuals and members of the public can participate, testify, or view and listen to these live, online meetings by using the link below.  Members of the public may also appear in person to view or provide testimony at the location indicated below.  Testimony may also be submitted in advance via email (csc@hawaii.gov), fax (808-586-0288), or mail (235 South Beretania Street, Room 300, Honolulu, Hawaii, 96813).

    Members of the public are invited to join this meeting with the above log-in information.  You will need a computer with internet access, a video camera, and microphone to participate. To avoid excessive noise/feedback, your microphone will be muted until called upon to testify by the Chair.  In the alternative, if you do not have remote access, you can come to our office located at 235 South Beretania Street, Room 300, Honolulu, HI 96813; however, seating is limited.

    1.                  Call to Order 

    2.                  Consideration and Approval of Minutes of Meeting on 11/18/22. 

    3.                  New Business 

    *Selection of Campaign Spending Commission Vice-Chair Position – Selection of the Commission’s Vice-Chair position. 

    *Proposed Conciliation Agreement No. 23-28 – In Re the Matter of Friends of Blake Boyd – The proposed conciliation agreement is offered to settle a claim by the Commission regarding the late filing of the 2nd Preliminary General Report in violation of Hawaii Revised Statutes sections 11-334 and 11-340.  The Commission will consider acceptance of the conciliation agreement and assessment of an administrative fine ($150).  

    *Proposed Conciliation Agreement No. 23-29 – In Re the Matter of Friends of Shekinah Cantere – The proposed conciliation agreement is offered to settle a claim by the Commission regarding the late filing of the 2nd Preliminary General Report in violation of Hawaii Revised Statutes sections 11-334 and 11-340.  The Commission will consider acceptance of the conciliation agreement and assessment of an administrative fine ($100).  

    *Docket No. 23-21 – In Re the Matter of Kelly Armstrong and Kelly J Armstrong – A complaint by the Executive Director against Kelly Armstrong and Kelly J Armstrong for the late filing of the 2nd Preliminary General Report in violation of Hawaii Revised Statutes sections 11-334 and 11-340.  The Commission to conduct an initial determination of the complaint in accordance with Hawaii Revised Statutes section 11-404 – i.e., summarily dismiss the complaint, investigate further, make a preliminary determination of the existence of probable cause to believe a violation of law has been committed, or refer the complaint to an appropriate prosecuting attorney for prosecution. 

    *Docket No. 23-23 – In Re the Matter of Theodene Allen and Friends of Theodene Allen – A complaint by the Executive Director against Theodene Allen and Friends of Friends of Theodene Allen for failing to report expenditures in violation of Hawaii Revised Statutes sections 11-331 and 11-410.  The Commission to conduct an initial determination of the complaint in accordance with Hawaii Revised Statutes section 11-404 – i.e., summarily dismiss the complaint, investigate further, make a preliminary determination of the existence of probable cause to believe a violation of law has been committed, or refer the complaint to an appropriate prosecuting attorney for prosecution. 

    *Report on 2022 Annual Online Survey – A report and discussion of the 2022 annual online survey of Commission operations and business. 

    4.                  Old Business 

    *Proposed Conciliation Agreement No. 23-27 – In Re the Matter of Kelly J Armstrong – The proposed conciliation agreement is offered to settle a claim by the Commission regarding the late filing of the 2nd Preliminary General Report in violation of Hawaii Revised Statutes sections 11-334 and 11-340.  The Commission will consider acceptance of the conciliation agreement and assessment of an administrative fine ($100).  

    *Docket No. 23-13 – In Re the Matter of Mark Ing and Friends of Kaniela Ing – An amended complaint by the Executive Director against Mark Ing and Friends of Kaniela Ing for the failure to file the Supplemental Report in violation of Hawaii Revised Statutes sections 11-334 and 11-410.  The Commission to conduct an initial determination of the complaint in accordance with Hawaii Revised Statutes section 11-404 – i.e., summarily dismiss the complaint, investigate further, make a preliminary determination of the existence of probable cause to believe a violation of law has been committed, or refer the complaint to an appropriate prosecuting attorney for prosecution. 

    The Commission may convene in an executive session pursuant to Hawaii Revised Statutes section 92-5(a)(4) to consult with the Commission’s attorneys on questions and issues pertaining to the Commission’s powers, duties, privileges, immunities, and liabilities regarding In Re the Matter of Mark Ing and Friends of Kaniela Ing. 

    5.                Report from Executive Director – Report on Compliance of Filing Timely Disclosure Reports; Report on Commission to Improve Standards of Conduct; Report on the 2022 COGEL Conference; and Update on the Certification Process of Candidates Elected in the 2022 Election. 

    6.                 Executive Session 

    *Consideration and Approval of Executive Session Minutes of Meeting on 11/18/22. 

    7.                  Next Meeting – Scheduled for Wednesday, January 11, 2023. 

     

    Agenda may be amended by the affirmative vote of four members of the Commission to the extent allowable by Hawaii Revised Statutes section 92-7(d). 

    If you would like to testify on any agenda item, please limit your testimony to 5 minutes per item.
