3.     Consideration of the Conduct of an Officer of the Council. Pursuant to HRS § 92-5(a)(2), the Committee will consider entering executive session to consider the conduct of an officer of the Council where consideration of matters affecting privacy will be involved. The individual concerned may request an open meeting; if requested, an open meeting shall be held.

a.      Determination whether the individual concerned has a legitimate expectation of privacy in the matters to be discussed.

b.     Motion and roll-call vote on whether to enter executive session under HRS §§ 92-4 and 92-5(a)(2).

c.      Executive session (closed to the public), if approved: discussion and deliberation.

d.     Return to open session.

4.     Announcement of Any Action Taken, in Open Session (if applicable). Any recommendation is referred to the full Council and, as applicable, to the appointing authority.
